The Reserve Bank of India (RBI) should comply with the Central Information Commission’s directive to reveal the names of wilful loan defaulters to let citizens have access to this information. Loans to corporate borrowers are disbursed from public deposits, and bad loans are a cost to the economy. This piece of information is also material to the share prices of listed companies that are in distress, and will enable an investor to take a call on whether or not to hold her investments. The onus should be on individual banks to name defaulters. This will put pressure on defaulters, even as banks have to use every possible way to recover loans. Information on wilful default — which broadly covers non-payment of dues despite adequate cash flow, siphoning off of funds to the detriment of the defaulting unit, fraudulent transactions by the borrower — are forwarded to Cibil. But the list is accessible only to other banks. There is no reason why fraud and mala fide should be hidden from the public.
