Source: The Economic Times · 8 Dec 2019The Citizenship Amendment Bill (CAB) is a troublesome idea. If the aim is to give formal refuge to victims of religious persecution in neighbouring countries who have fled to India, the stated goal of the law, what India needs to draw up is a proper law on refugees. The basic problem in CAB is that it offers to make citizenship based on religious affiliation. That there was discrimination against Hindus in Pakistan and erstwhile East Pakistan is not in doubt. That India has a responsibility to give protection to those persecuted is also not in doubt. The issue here is that quick processing of citizenship claims is entirely possible without the relevant law explicitly mentioning religion. Suppose the Taliban, which may rule Afghanistan again, targets that country’s minuscule Hindu and Sikh population. Of course, India should provide shelter and citizenship to such people. But this should be no different from India’s approach to some sects of Muslims who face persecution in Pakistan. India’s stance should be consistent.
