Source: The Economic Times · 26 Jan 2021The National Company Law Tribunal (NCLT) erred, when it restrained rating agencies from downgrading finance company Srei Equipment Finance Ltd (SEFL). Ratings primarily reflect the current ability of a company to honour and service debt based on its financial health and cash flow conditions.
Rating agencies are agnostic about whether a borrower is delinquent, a victim of adverse circumstance or plain inefficient. Their ratings help investors to take informed investment decisions based on the credit risk and their own risk return expectations. A freeze on ratings of a company that is undergoing insolvency resolution could make investors lose their shirts if the company were to raise fresh debt based, say, on some superlative ratings in the past.
