Transparent justice
Installing CCTVs in courts is a step forward, now tackle judicial delays. The Supreme Court's order directing high courts to install CCTV cameras inside courtrooms in two districts of every state and union territory within three months is a welcome move. This move will usher in transparency, better case management and improve public behaviour within the courts. It can herald a mindset change in the Indian judicial system that's much needed. It has often been observed that to overcome the problem of excessive judicial delays, judiciary and executive must quickly overcome their differences and finalise the Memorandum of Procedure (MoP) for appointment of judges to various courts in the country. That certainly ought to happen, but the problem of judicial delay predates differences between executive and judiciary on appointment of judges. There are over three crore pending cases in various courts, all of which cannot be attributed to a shortage of judges. There is also a culture of delays, which the judiciary needs to tackle. Frequent adjournments delay cases by many months as dates are given after long gaps. A study shows adjournments were sought and granted in 91% of the cases delayed over two years at the Delhi high court. The process bleeds litigants and benefits none except lawyers who charge clients on a per hearing basis. India also needs to embrace global practices like simplification of judicial proceedings and using new technology to improve access, quality and efficiency of justice. For instance, reforms carried out in Singapore in the 90s led to speedy disposal of over 95% cases. Courts also need to discourage filing of cases without merit and frivolous PILs which end up impeding other cases. Government must also withdraw petty cases from courts as it is the biggest litigant accounting for nearly 46% of cases.
