Source: The Economic Times · 26 Jun 2019Following the tragic death of 150 young children in Bihar’s Muzaffarpur, the Supreme Court is right to uphold medical care as a basic right. In various judgments, it has held that the right to health is a part of the right to life enshrined under Article 21of the Constitution. As India is a party to international pacts that recognise the right to life, the Supreme Court in its ruling (People’s Union for Civil Liberties vs Union of India 1997) held that Article 21 must be interpreted in conformity with international law. In another judgment, it held that the failure of a government hospital to provide a patient timely medical treatment results in violation of the patient’s right to life. Likewise, the court also upheld the state’s obligation to maintain health services. Even so, people find it tough to seek redressal against medical negligence. The remedy is to bring healthcare services under the ambit of the new Consumer Protection Law, rather than remove it from the list of specific services, as has been reported.
