The government reportedly wants to amend the Indian Telegraph Act and the Prevention of Money Laundering Act (PMLA) to provide legal backing for mobile numbers and bank accounts to be linked to Aadhaar on a voluntary basis. A course correction makes eminent sense following the Supreme Court’s ruling that bars private entities that include the telecom industry and private banks from carrying out Aadhaar-Based Biometric Authentication (ABBA). ABBA is an extremely efficient and low-cost method of verifying identity. However, for purposes that do no involve government expenditure, the validity of using Aadhaar is suspect — thanks to the dubious classification of the Aadhaar Bill as a money Bill and bypassing the Rajya Sabha. It makes sense to put in place a robust data protection law and bring in Aadhaar as a non-money Bill, so that its use is valid for purposes other than those that involve expenditure from the exchequer.
