The aryan lesson cops can’t defame courts must follow evidence
Narcotics Control Bureau’s admission in its chargesheet in the drugs raid on a luxury cruise that no drugs were found on Aryan Khan calls for some rewinding to October last year when he was held in custody for nearly four weeks. Because going back will help us take note of two key issues. First, WhatsApp conversations of Aryan with an actress were leaked to the media to maliciously suggest that he was a drug trafficker. Before the purported “evidence” even reached court through a chargesheet, it was laundered in public.The intent was clear: reputational damage and moulding public opinion against Aryan. This was utterly unconstitutional: it was a violation of the right to be deemed innocent before guilt is proven, right to a fair trial, right to reputation, and right to privacy. The buck stops with investigating officers for leaks and NCB’s ex-honcho Sameer Wankhede must be probed. It will also deter other cops from trying the same stunt.
The second aspect of Aryan’s case was the approach of courts. NCB’s candid admission now that Aryan wasn’t found with drugs was evident even then. Yet he was denied bail twice: by a magistrate’s court and a session’s court before the Bombay high court called the NCB’s bluff. In many cases custody isn’t necessary. Suspects can be questioned without the harsh optics of arresting them. What was done to Aryan Khan mustn’t happen again.
